1. Introduction and Acceptance of Terms
Welcome to FluxIT Service. These Terms of Service ("Terms", "ToS", "Agreement") constitute a legally binding agreement between you ("Customer", "You", "Your") and FluxIT Service ("FluxIT", "We", "Us", "Our"), governing your use of our web hosting, domain registration, and related services.
By accessing our website at gazduire.fluxit.ro, creating an account, purchasing services, or using any of our products, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our:
- Privacy Policy
- Acceptable Use Policy (AUP)
- Service Level Agreement (SLA)
- Refund Policy
- Cookie Policy
If you do not agree to these terms, you must not use our services.
1.1 Amendments to Terms
We reserve the right to modify, update, or change these Terms at any time. Changes will be effective:
- Immediately upon posting to our website for new customers
- After 30 days' notice for existing customers with active services
We will notify you of significant changes via:
- Email to your registered account address
- Notice in the client portal
- Announcement banner on our website
Continued use of our services after changes take effect constitutes acceptance of the modified Terms.
1.2 Agreement Hierarchy
In case of conflict between documents, the order of precedence is:
- Service-specific agreements or addendums
- These Terms of Service
- Acceptable Use Policy (AUP)
- Service Level Agreement (SLA)
- Other policies referenced herein
2. Eligibility and Account Registration
2.1 Age and Legal Capacity
To use our services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using our services under applicable laws
If you are under 18, your parent or legal guardian must accept these Terms on your behalf and supervise your use of our services.
2.2 Account Registration
When creating an account, you must:
- Provide accurate, current, and complete information
- Use your real name and valid contact details
- Maintain and promptly update your account information
- Not impersonate another person or entity
- Not create multiple accounts without authorization
2.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your password and account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Using strong passwords and enabling two-factor authentication (2FA) when available
We are not liable for any loss or damage arising from your failure to secure your account.
2.4 Account Verification
We reserve the right to:
- Verify your identity and contact information
- Request additional documentation (ID, proof of address, business registration)
- Suspend or terminate accounts that fail verification
- Reject accounts we believe are fraudulent or violate our policies
3. Services Offered
3.1 Hosting Services
We provide various hosting solutions, including but not limited to:
Shared Hosting: Multiple websites hosted on shared server resources Business Hosting: Enhanced shared hosting with additional resources VPS Hosting: Virtual Private Server with dedicated resources Dedicated Servers: Physical servers dedicated to your use Reseller Hosting: Hosting packages for reselling to your clients
3.2 Domain Services
Domain Registration: Register new domain names through our registrar partners Domain Transfer: Transfer existing domains to our management Domain Renewal: Automatic or manual domain renewal services DNS Management: Configure DNS records for your domains
3.3 Additional Services
- SSL/TLS Certificates (free and premium)
- Email hosting and management
- Website migration assistance
- Backup and restore services
- Server management and administration
- Security add-ons (malware scanning, DDoS protection)
- Content Delivery Network (CDN) integration
3.4 Service Availability
Services are provided on an "as-is" and "as-available" basis. While we strive for high availability (see our SLA), we do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.
4. Payment Terms and Billing
4.1 Pricing and Fees
- All prices are displayed in Romanian Lei (RON) or Euros (EUR) as indicated
- Prices are subject to change with 30 days' notice for existing customers
- New pricing applies immediately to new customers
- Promotional pricing is valid only for the initial term unless stated otherwise
4.2 Payment Methods
We accept:
- Credit/Debit Cards (Visa, Mastercard)
- PayPal
- Netopia Payments
- Bank Transfer (for invoices over 500 RON)
4.3 Billing Cycles
Services are billed according to your chosen billing cycle:
- Monthly
- Quarterly (3 months)
- Semi-annually (6 months)
- Annually (12 months)
- Biennially (24 months)
4.4 Automatic Renewal
By default, services are set to automatically renew to prevent service interruption.
- Renewal charges are processed 7 days before the service expiration date
- You will receive renewal reminders via email at 30, 14, and 7 days before renewal
- You can disable automatic renewal in your account settings
- If automatic renewal is disabled, services will be suspended upon expiration
4.5 Invoices and Receipts
- Invoices are generated automatically and sent via email
- Invoices are also available in your client portal
- Romanian VAT (TVA) is applied to invoices for Romanian customers
- EU VAT is applied according to EU regulations (reverse charge for valid VAT IDs)
4.6 Late Payments and Suspension
Payment Due Date: Services must be paid by the due date on the invoice.
Grace Period: 7 days from the due date before suspension.
Suspension Process:
- Day 1-7: Service remains active, reminder emails sent
- Day 8: Service suspended (websites/email inaccessible)
- Day 15: Suspension reminder sent
- Day 30: Account terminated, data deleted
Reactivation:
- Pay outstanding invoices plus any applicable late fees
- Reactivation fee: 50 RON for suspended accounts
- No fee if payment is made within the grace period
4.7 Refunds
Please refer to our Refund Policy for complete information about refunds and money-back guarantees.
4.8 Chargebacks
Filing a chargeback instead of contacting us will result in:
- Immediate account termination
- Permanent ban from FluxIT services
- Reporting to fraud prevention databases
- Legal action to recover losses and fees

5. Fair Use and Resource Limits
5.1 Shared Hosting Resource Policy
Shared hosting services include "unlimited" bandwidth and storage, subject to fair use:
Fair Use Defined:
- Resources are shared among multiple users
- Your usage must not negatively impact other users
- "Unlimited" does not mean infinite or unrestricted
Resource Limits:
- CPU usage: Average 25% of one core
- RAM: 2GB per account (varies by plan)
- I/O operations: 1MB/s average
- Inode limit: 250,000 files per account
- Email sending: 500 emails per hour per account
5.2 Excessive Resource Usage
If your account consistently exceeds fair use limits:
- First Notice: Email notification with usage statistics
- Second Notice: 48-hour warning to reduce usage or upgrade
- Suspension: Temporary suspension if limits continue to be exceeded
- Upgrade Requirement: Must upgrade to VPS/dedicated or optimize usage
5.3 Storage and Backup Limitations
Prohibited Storage:
- File hosting or distribution services
- Media streaming repositories
- Backup storage for off-site systems
- Archive/mirror sites
- Cryptocurrency mining data
Backup Limits:
- Automated backups: Last 7 days (shared), configurable (VPS/dedicated)
- Backup restoration: Free for disaster recovery
- Individual file restoration: May incur fees after 3 requests per month
6. Acceptable Use Policy (AUP)
Your use of our services must comply with our Acceptable Use Policy. The following activities are strictly prohibited:
6.1 Illegal Activities
- Child sexual abuse material (CSAM)
- Terrorism-related content
- Copyright or trademark infringement
- Identity theft or fraud
- Illegal gambling operations
- Sale of illegal substances or weapons
- Money laundering or financial fraud
6.2 Abusive Behavior
- Spam: Sending unsolicited bulk email (UCE/UBE)
- Phishing: Fraudulent attempts to obtain sensitive information
- Malware: Hosting or distributing viruses, ransomware, trojans
- Hacking: Unauthorized access attempts, port scanning, vulnerability exploitation
- DDoS: Participating in distributed denial-of-service attacks
6.3 Prohibited Content
- Hate speech or content inciting violence
- Harassment, bullying, or stalking
- Adult content (pornography) on shared hosting
- Warez, pirated software, or illegal file sharing
- Counterfeit goods or services
6.4 Resource Abuse
- Cryptocurrency mining
- Proxy services or VPN exit nodes (unless explicitly permitted)
- Tor exit nodes
- File storage services that violate fair use
- Excessive API calls or automated scraping
6.5 Network Abuse
- Email bombing or mail flooding
- IRC bots or scripts causing network disruption
- Packet sniffing or spoofing
- Exploiting vulnerabilities in our infrastructure
Violation Consequences:
- First offense: Warning and 24-hour correction period
- Second offense: Temporary suspension
- Severe violations: Immediate termination without refund
- Illegal activities: Report to law enforcement
7. Content and Data Ownership
7.1 Your Content
You retain all ownership rights to content you upload, store, or transmit through our services ("Customer Content").
Your Responsibilities:
- Ensure you have all necessary rights and licenses
- Comply with copyright, trademark, and intellectual property laws
- Maintain backups of your important data
- Remove any content that violates these Terms when notified
7.2 License to FluxIT
By using our services, you grant us a limited license to:
- Store, cache, and display your content as necessary to provide services
- Create backup copies of your content
- Perform technical modifications (compression, format conversion) for service optimization
- Access your content to provide technical support when requested
This license terminates when you delete the content or close your account.
7.3 DMCA and Copyright Compliance
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA) and EU Copyright Directive.
Copyright Infringement Notice: If you believe content hosted on our servers infringes your copyright, send a DMCA notice to dmca@fluxit.ro including:
- Your contact information
- Identification of the copyrighted work
- URL of the infringing material
- Good faith statement that use is not authorized
- Statement that the information is accurate
- Your physical or electronic signature
Counter-Notice: If your content was removed due to a DMCA complaint, you may file a counter-notice if you believe the removal was in error.
Repeat Infringer Policy: Accounts with repeated copyright violations will be terminated.
7.4 Data Backup and Recovery
Your Responsibility:
- You are solely responsible for backing up your data
- Our backup services are for disaster recovery, not guaranteed data retention
- We do not guarantee backup availability or successful restoration
Data Loss: We are not liable for any data loss, even if caused by our error or negligence. Always maintain your own backups.
8. Privacy and Data Protection
8.1 Data Processing
We process your personal data in accordance with:
- EU General Data Protection Regulation (GDPR)
- Romanian Data Protection Law (Law 190/2018)

8.2 Your Rights
Under GDPR, you have the right to:
- Access your personal data
- Rectify inaccurate data
- Request data deletion ("right to be forgotten")
- Restrict or object to data processing

8.3 Data Location

- Backup locations: European Union
- We do not transfer data outside the EU without appropriate safeguards
8.4 Data Retention
- Active account data: Retained while account is active
- Terminated accounts: Data deleted after 30 days
- Billing records: Retained for 10 years (legal requirement)
- Log files: Retained for up to 90 days
9. Intellectual Property
9.1 FluxIT Intellectual Property
All content, features, and functionality on our website and services, including but not limited to:
- Text, graphics, logos, images
- Software, source code, and APIs
- Trademarks and service marks
- Design, layout, and user interface
are owned by FluxIT Service and protected by copyright, trademark, and other intellectual property laws.
9.2 Restrictions
You may not:
- Copy, modify, or create derivative works of our platform
- Reverse engineer our software or services
- Use our trademarks without written permission
- Frame or mirror our website content
- Use automated tools to access our services without permission
9.3 Licensed Software
Some services include third-party software (cPanel, Plesk, etc.) subject to separate license agreements. You must comply with those licenses.
10. Service Suspension and Termination
10.1 Suspension by FluxIT
We may suspend your services immediately without notice for:
- Non-payment of invoices (after grace period)
- AUP violations
- Security threats to our infrastructure
- Legal requirement or court order
- Excessive resource usage threatening service stability
- Fraudulent activity
10.2 Termination by FluxIT
We may terminate your account for:
- Repeated AUP violations
- Fraudulent account information
- Chargeback filing without prior contact
- Severe security incidents
- Any reason with 30 days' notice for non-violation terminations
10.3 Termination by Customer
You may cancel services at any time through:
- Client portal (automatic processing)
- Support ticket
- Email to billing@fluxit.ro
Cancellation Policy:
- Monthly services: Cancel anytime, no refund for partial month
- Annual services: May be eligible for pro-rated refund (see Refund Policy)
- Cancellation takes effect at the end of the current billing period (unless immediate cancellation requested)
- Domain registrations cannot be refunded once processed
10.4 Effect of Termination
Upon termination:
- All services are immediately deactivated
- Data is retained for 7 days for retrieval
- After 7 days, all data is permanently deleted
- No refunds for pre-paid periods (unless policy allows)
- Outstanding invoices remain due
Download Your Data: Always download your data before requesting account termination.
11. Warranties and Disclaimers
11.1 Service Warranty
We warrant that our services will be provided in a professional manner consistent with industry standards. However:
SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
11.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:
- Merchantability: Fitness for a particular purpose
- Non-infringement: That services won't violate third-party rights
- Uninterrupted Service: Continuous, error-free operation
- Security: Complete protection against all threats
- Data Accuracy: Accuracy or completeness of content
- Results: That services will meet your specific requirements
11.3 Third-Party Services
We may integrate third-party services (payment processors, CDN providers, etc.). We are not responsible for:
- Availability or performance of third-party services
- Third-party terms of service or privacy policies
- Actions or omissions of third-party providers
11.4 Customer Responsibilities
You are solely responsible for:
- Compatibility of your applications with our services
- Security of your content and applications
- Compliance with applicable laws and regulations
- Backup of your data
- Actions of users you authorize to access your account
12. Limitation of Liability
12.1 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED:
The total amount you paid to us in the 12 months preceding the claim, or 100 EUR, whichever is greater.
12.2 Excluded Damages
WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business opportunities
- Loss of data or inability to use services
- Costs of substitute services
- Business interruption or downtime
- Reputation damage
- Loss of goodwill
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.3 Exceptions
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded under applicable law
12.4 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
- Natural disasters (earthquakes, floods, fires)
- War, terrorism, civil unrest
- Government actions or regulations
- Internet backbone failures
- Power outages or telecommunications failures
- Pandemic or epidemic
- Strikes or labor disputes
- Supplier failures
13. Indemnification
13.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless FluxIT Service, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to:
- Your use of our services
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any rights of third parties
- Your content or data
- Actions of users you authorize to access your account
13.2 Indemnification Process
If we seek indemnification from you:
- We will promptly notify you of the claim
- You will have the right to control the defense
- We may participate in the defense at our expense
- You will not settle claims without our consent if it affects our interests
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.
14.3 Informal Resolution
Before filing any formal legal action, you agree to contact us at legal@fluxit.ro to attempt to resolve the dispute informally.
14.4 Arbitration (Optional)
We may offer binding arbitration as an alternative to litigation. If offered:
- Arbitration will be conducted in Bucharest, Romania
- Arbitration will follow Romanian Chamber of Commerce rules
- The arbitrator's decision will be final and binding
- Each party bears their own costs
14.5 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
14.6 Time Limitation
Any claim related to our services must be filed within one (1) year after the cause of action arises, or be forever barred.
15. General Provisions
15.1 Entire Agreement
These Terms, together with referenced policies, constitute the entire agreement between you and FluxIT Service and supersede all prior agreements and understandings.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
15.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any successor or affiliate without restriction.

Notices are effective upon sending (email) or 3 days after mailing (physical mail).
15.6 Relationship of Parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and FluxIT Service.
15.7 Survival
Provisions that by their nature should survive termination will survive, including: ownership, warranties, indemnification, limitations of liability, and dispute resolution.
15.8 Language
These Terms are written in English. If translated, the English version prevails in case of conflict.

16. Specific Service Terms
16.1 Domain Registration
Registry Policies: Domain registrations are subject to registry policies (ICANN for .com/.net, specific country registries for ccTLDs).
Domain Ownership: You are the registrant and owner of domains registered through us.
Domain Transfer: Domains can be transferred after 60 days from registration/transfer. Transfer lock must be disabled.
Domain Expiration:
- Grace period: 30 days after expiration (no penalty)
- Redemption period: 30 days after grace period (redemption fee applies)
- Deletion: Domain is released to public after redemption period
WHOIS Privacy: Free WHOIS privacy protection where allowed by registry.
16.2 SSL/TLS Certificates
Validation: Domain validation required before certificate issuance.
Renewal: Certificates must be renewed before expiration (typically 90 days for Let's Encrypt, 1 year for commercial).
Revocation: We may revoke certificates if security concerns arise.
16.3 Email Services
Sending Limits: 500 emails per hour per account (shared hosting).
Spam Policy: Strictly prohibited. Violations result in immediate suspension.
Storage: Email storage counts toward disk quota.
Retention: We do not guarantee email retention beyond standard backup periods.
16.4 VPS and Dedicated Servers
Root Access: You have full root/administrator access and are responsible for server management.
Operating System: We provide OS installation but not configuration support (unless managed service purchased).
Software Updates: You are responsible for security patches and updates (unless managed).
Reboots: We may reboot servers for critical security patches or hardware maintenance.
17. Reseller Services
17.1 Reseller Responsibilities
As a reseller, you are responsible for:
- Your end-customers' compliance with our AUP and Terms
- Billing and customer support for your clients
- Ensuring your clients understand they are your customers, not direct FluxIT customers
17.2 Reseller Restrictions
Resellers may not:
- Resell services at prices lower than our public pricing
- Misrepresent themselves as FluxIT Service
- Use our branding without permission
- Violate our AUP through their clients' actions
17.3 Reseller Liability
You are liable for all activities of your end-customers. Violations by your clients may result in suspension or termination of your reseller account.
18. Beta and Trial Services
18.1 Beta Services
Services marked as "beta", "preview", or "experimental" are provided for testing purposes:
- May be unstable or have limited functionality
- Provided "as-is" with no warranties
- May be discontinued without notice
- Data may be deleted when beta period ends
18.2 Trial Periods
Free trials are subject to:
- One trial per customer
- Limited features or resources
- Automatic conversion to paid plan unless cancelled
- No service level guarantees
19. Compliance and Legal Requirements
19.1 Romanian Law Compliance
We comply with Romanian laws regarding:
- Consumer protection (OUG 34/2014)
- Electronic commerce (Law 365/2002)
- Data protection (Law 190/2018)
- Fiscal obligations (Romanian Tax Code)
19.2 EU Compliance
We comply with EU regulations:
- GDPR (General Data Protection Regulation)
- PSD2 (Payment Services Directive)
- ePrivacy Directive (Cookie Law)
- Consumer Rights Directive
19.3 Export Controls
Our services may not be used in countries subject to embargo or by persons on restricted party lists.
19.4 Law Enforcement Cooperation
We cooperate with law enforcement when legally required and may disclose account information pursuant to:
- Valid court orders or subpoenas
- Emergency situations involving danger to life
- Romanian and EU legal requirements
